General conditions of sale

 

Article 1. General clause

The present general conditions of sale apply solely to all purchases made via the website www.merckxeditions.com. The applicable general conditions of sale are those in force on the website on the date of sale.

 

Article 2. The seller

The website www.merckxeditions.com is the property of Editions Merckx Uitgeverij s.p.r.l., known commercially as Vincent Merckx Editions. This company’s head office is based at 145A Avenue des Statuaires, B-1180 Brussels (Belgium). This company is hereafter referred to by the words ‘we’ and ‘our’.

 

Article 3. Confidentiality

Buyer details known to us (addresses, telephone numbers, email addresses) will not be divulged to third parties. We shall not use these details to send unsolicited emails (spam).

 

Article 4. Price

The prices of items appearing on the website www.merckxeditions.com are shown in euros and include VAT. They do not include other taxes or charges such as customs duties. Postal charges will be added to the prices of all items bought and will be taken into account separately upon confirmation of purchase.

 

Article 5. Confirmation of purchase

Following validation of a purchase by the buyer, the buyer will receive an automatic email from our website confirming receipt of purchase.

 

Article 6. Payment methods

The buyer may choose one of the following two methods of payment for items purchased on the site www.merckxeditions.com:

1)      European bank transfer via the buyer’s own banking institution. Buyers in the euro zone will not incur bank charges on this type of transfer.

2)      Via the secure online payment site PayPal. This site does not pass on to us any bank or financial details relating to the buyer. For more information, see paypal.com .

The buyer must indicate the preferred payment method upon validation of the order.

 

Article 7. Dispatch

Purchased items will be dispatched (will leave our premises) within 5 working days of purchase, depending on the chosen payment method:

1)     For European transfer payments, items will be dispatched once our bank account has been credited with the amount paid by the buyer;

2)     For payments via PayPal, items will be dispatched once we have received confirmation of a valid payment from PayPal.

 

Article 8. Delivery

The method of transport and the delivery company are chosen firstly on the basis of cost, then according to delivery times. The purchaser may not choose the delivery company. Delivery times vary according to the destination country. For information only and with no obligation on our part, delivery takes 1 to 2 days within Belgium, 3 to 4 days for neighbouring countries and 1 week for North America.

 

Article 9. Unavailability

Should a purchased item be unavailable, we undertake to inform the buyer within 5 days of purchase. The buyer will be kept informed of possible new supply dates. If an item should be permanently unavailable, the buyer will be refunded within 5 working days of purchase and any financial costs associated with this refund will be borne by us.

We cannot be held responsible for any inconvenience or distress caused to the buyer, either directly or indirectly, by the unavailability of an item.

 

Article 10. Customs duties

Items delivered outside the European Union may be subject to customs duties. Any such duties are payable by the buyer.

 

Article 11. Lost goods

All goods purchased are sent by recorded delivery with acknowledgement of receipt. If an item does not reach the buyer, the buyer should advise us of non-receipt by email to info@merckxeditions.com. We shall inform the buyer of the whereabouts of the order as soon as possible. Should an order become lost during delivery, the item will be re-sent at no extra charge to the buyer.

 

Article 12. Defective or damaged goods

Items are dispatched in reinforced cardboard packaging, specially designed for the postal delivery of our books. Damage caused during transportation occurs extremely rarely.

 

Nevertheless, if an item is found to be damaged upon delivery, if it is defective or does not correspond to the item purchased, the buyer must notify us within 2 days of receipt via email to info@merckxeditions.com. The defective article must be returned to us within 14 days of receipt. The costs of returning the item will be reimbursed to the buyer within 14 days of receipt of the defective article and following confirmation that it is indeed defective.

 

Article 13. Returns

Private buyers have a period of 14 working days following receipt of an item in which to cancel the purchase and to return the item to the address shown in article 2 above. The return charges will be borne by the buyer.

 

Article 14. Applicable law and Courts with jurisdiction

All purchases made via the website www.merckxeditions.com are subject solely to Belgian law. Any dispute relating to such a purchase falls within the sole legal jurisdiction of the Courts of Brussels.
